  1. Article 1: Acceptance of the Special Conditions of Sale

These Special Conditions of Sale apply to any travel reservation made
BURGUNDY & MORE ®. They supplement the advance information provided to
traveller prior to purchase, pursuant to articles L. 211-8 and R. 211-4 of the
version after 1 July 2018 and inform the Client of the conditions under which
BURGUNDY & MORE ® offers its services
1.2. The Client acknowledges that it has the capacity to contract under the conditions described in the Sale presented below.
1.3. The Customer acknowledges having received and became aware of these Terms of Sale in their
specific conditions for certain services, as well as all the terms of the proposal before making the reservation

Article 2: Definitions

Customer(s), Buyer or Traveller:
Identifies individuals or corporations who have entered into a travel contract with BURGUNDY & MORE® or who are entitled to travel on the basis of that contract.
Home page: Refers to the part of the Site from which any person can access the Services;
Tourist package: Refers to the service provided by BURGUNDY & MORE® or sold under the name of
“package” means Resulting from the combination, prior or subsequent to a contract authorizing the traveller to choose from a selection of different travel services, at least two (2) different types of servicesof travel exceeding 24 hours or including one night’s stay relating to transport, the
accommodation or other tourist services representing at least 25% of the price of the package and advertised as or constituting an essential feature of the package; Sold or offered for sale at an all-inclusive price, as defined in Article L.211-2-II-A of the tourism.

Partner:
Refers to any third party service provider, namely, rail carriers SNCF, hoteliers, tour operators, car rental companies, insurance companies selected by BURGUNDY & MORE®.
Travel services and services:
Refers to the services that BURGUNDY & MORE® does not produce itself: transportation, accommodation, rental of vehicles and other tourist services that are not an integral part of a travel service and can be booked on their own.
Service(s) for:
Refers to all the services made available to Users, by BURGUNDY & MORE® namely, the provision of train tickets, accommodation services, Car rental services with or without driver, provision of staff: interpreter, tourist guide, rental of villas, residences, provision of tourist packages, or any other service provided by BURGUNDY & MORE® or Partners.
Site:
Refers to the BURGUNDY & MORE® website at URL: “www.burgundyandmore.com”
User(s):
Refers to any legal or natural person who consults the Site and wishes to benefit from the Services of BURGUNDY & MORE®.

Article 3: Purpose

3.1. The present Special Conditions of Sale lay down the technical, legal and
in which Users access the Services of the Site in order to consult the offer of
BURGUNDY & MORE®:
• Tourist package
• Train ticket and airfare;
• Rental of hotel rooms;
• Rental of vehicles
• Rental of boats, planes, villas, tourist residences;


3.2. In the case of the sale of transport ticketing alone, the Customer is informed that in accordance with Articles L. 211-1_V and L. 211-7 of the Tourism Code, BURGUNDY & MORE® intervenes only as an agent and cannot be declared liable for any misperformance of the service attributable to the Partner whose general and special conditions of sale are applicable.

Article 4: Access to the Site

Access to the Site can be accessed directly at the following URL: www. burgundyandmore.com.
The Site is accessible 24 hours a day and 7 days a week. However, the Site may occasionally
the purpose of technical maintenance, maintenance and updating operations, resulting in their temporary unavailability.
Transport ticket issues and order processing by BURGUNDY & MORE® take place from Monday to Friday between 9:30 a.m. and 6:30 p.m. (French time – GTM + 1).

Article 5: Required Configuration

5.1. The Client is informed that the minimum IT configuration required to allow access complete to the Service is as follows:
Browser: Microsoft Edge, Firefox 59 , Safari, Opera 49, Chrome 72
BURGUNDY & MORE® shall not be liable under any circumstances as a result of the Customer’s use of any hardware or software that does not comply with the minimum configuration specified above.
5.2. Some of the data consulted and exchanged on the Site are secured by an encryption of type SSL 128 bits.

Article 6: Price

6.1. All prices are displayed in Euros (€) including all taxes (including VAT). They are expressed on a
double room base, from and in low season with indexation for the high season July and August. The price of the offer will be communicated to the Client on its quote and the contract will confirm the final price according to the date of the request and the travel.
The agency fees applicable to bookings will be indicated to the Customer in its preliminary description.
6.2. Off-package services
The services purchased by the Client before his departure or on site without the agreement or intervention of BURGUNDY & MORE® will not be included in the tourism package and will not benefit from scheme established by the Tourism Code for the sale of tourist services.
6.3. Accommodation and Tourist Packages
6.3.1. Only the benefits explicitly mentioned in the travel descriptions are included in the price. Unless expressly stated otherwise, our prices do not include:
• Charges for connection to the Site;
• Visa fees; and
• Optional tours and excursions;
• Beverages, gratuities and personal expenses;
• Meals, if any, excluding references to the quote and contract
• Complementary insurance
• Excess baggage; and

6.3.2. In accordance with Articles L.211 – 12, R. 211-8 and R. 211-9 of the Tourism Code, BURGUNDY & MORE® may change the price of the trip, both up and down, to take into account the following variations:
The cost of transportation, including the cost of fuel and other energy sources, the various taxes and charges on travel services imposed by a third party that is not directly involved in the performance of the contract: touring, landing, boarding, landing in ports except airports.Changes in the cost of transport and the various related taxes will be passed on only in proportion to their share in the calculation of the price of the trip;
• The exchange rate in relation to the contract when part of the benefits is invoiced to BURGUNDY & MORE® in foreign currency.These variations will be reflected only in proportion to their share in the calculation of the price of the trip.

BURGUNDY & MORE® will inform the Customer as soon as possible, on a durable medium, of any increase in prices no later than 20 days before departure accompanied by a justification; and the methods of calculation.
6.3.3. In the event that pursuant to 7.3.2 below BURGUNDY & MORE® is would find it necessary to modify by more than 8 % the price originally stipulated, the Customer will receive clear, understandable and apparent information on a durable medium on: the proposed increase and its impact on the price
– their choice between terminating their contract and obtaining, without penalty, the reimbursement within 14 days of the amounts paid OR accepting the amendment proposed by BURGUNDY & MORE®. An amendment to the contract specifying the amendments made must then be regularized between the parties, it being understood that it may be concluded electronically, so that the provisions of Article 16 hereinafterafter it will be perfectly applicable.

Article 7: Means of payment

7.1. The price of the Services must be paid online by the Customer at BURGUNDY & MORE® by:
• credit card (Blue Card, Visa, Eurocard/Mastercard, American Express)
• cheque
• transfer
• species within legal ceilings
In all cases, regardless of the method of payment used, BURGUNDY & MORE® undertakes to debit the Client’s bank account or prepaid account only after confirmation of the availability of offers by the Partners.
7.2. In the event that the payment proves to be irregular, incomplete or non-existent, for any reason attributable to the Customer, the order would be cancelled as a result of its fact, the consequences resulting remaining the Customer’s charge.
Any delay in payment by a professional shall be triggered in accordance with Article L.441-6 of the Code
an indemnity calculated on the basis of three times the legal interest rate in force and a flat-rate allowance for recovery costs of EUR 50.

Section 8: Terms of Settlement

For all orders within 35 days of departure, payment of the full amount of the trip will be required.
More than 35 days before departure, the booking involves the immediate payment of a deposit at least
30% of the total amount except for specific services; in this case, the payment terms will be indicated before the confirmation of the reservation.

The balance is payable no later than 35 days before departure.
Not considered to be debt release: the provision of credit card details until the authorization of the payment authorization centre is obtained, the deposit of a cheque until it is debited (except bank cheque), a transfer request before confirmation of receipt of funds by our bank.
Instalments and balances must be cashable within 24 working hours of their due date.
Where the details of a credit card have been provided as collateral for a means of payment by the Customer, they will make it possible to settle the amount due if the said means of payment does not allow a collection within the defined time-limits.
In any case, if the payment could not be made at the end of the period defined, BURGUNDY & MORE® will then be well founded to acknowledge the resolution of the contract due to the Client to the conditions applicable to Article 15 hereof.

Article 9: Duration of travel

For the Tourist Packages, the duration of the trips indicated on the Site includes the day of departure,
from the convening time, and from the day of return to the time of arrival at destination.


Article 10: Photographs and Illustrations

The photographs and illustrations on the Site have an illustrative value. It is recalled that Minimal variations may appear between the photos on the descriptive cards and the products provided.


Article 11: Formalities / vaccinations

11.1. BURGUNDY & MORE® provides the Client, from the Site, with general information relating to
the necessary administrative formalities (ID and visas with duration of acquisition in particular) in order to cross the borders, as well as to the health formalities advised; or Mandatory. In all cases, the Customer is responsible for the completion of these customs or sanitary administrative formalities. Unless it is due to BURGUNDY & MORE®, a User who could not embark on a flight, failing to present the documents required by the competent administrative authorities (passport, visa, vaccination certificate, tickets, etc.) will not be eligible for reimbursement.
11.2. Underage children must possess identification in their name with photography. Minors must hold an individual passport. Registrations of minors on the passports of parents, including “old model” passports called Delphine passports, are now impossible.

Article 12 : accommodation and stay

12.1. Classification of the hotel establishment
The number of stars attributed to a hotel appearing on the Site is communicated to BURGUNDY and MORE ® by his Partners and corresponds to the current local standards within the country where is establishes the hotel and thus can postpone French or international standards on the subject.
12.2. Modification of the hotel establishment
Within the framework of the tourist Packages, BURGUNDY and MORE ® can be forced before the departure to substitute for the hotel establishment initially planned a hotel establishment of the same category. BURGUNDY and MORE ® commits naturally to you to inform about it as soon as possible in a clear, understandable and visible way about a sustainable support. You can then:

An amendment to the contract specifying the changes made will then be regularized between the parties, it being understood that it may be concluded electronically, so that the provisions of Article 16 hereinafterafter it will be perfectly applicable.
12.3. The meals
When meals are included in the benefit, their number depends on the number of nights spent.
The full board includes breakfast, lunch and dinner, according to the service schedules set by the hotel concerned.
Half board includes breakfast and one meal per day.
Due to the hours or the delay of your transport, certain meals may be provided at the time of the said transport. Unless otherwise expressly stated, drinks are not included as part of full or half board. All non-standard drinks are at your own expense.
12.4. The Activities
The Client is informed that the sporting and leisure activities mentioned on the description of the accommodation on the Site are only of an indicative nature and can be modified by the host or accommodation establishment.
12.5. Visits to cellars, or “All Inclusive” formula that can allow an unlimited consumption of some alcohol for adults: alcohol abuse is dangerous to health. BURGUNDY & MORE® will not be responsible for the consequences of any abuse or excessive consumption of alcohol.

Article 13: Availability of tenders

All offers offered on the Site are the result of communications made by our Partners, and their availability must be confirmed by BURGUNDY & MORE® before the contract is concluded.


Article 14: Cancellation / Cancellation Fees

The following cancellation terms and charges apply to all Services, except as provided herein specific programmes described in the programmes concerned, which are the summary card of the order.
14.1. Tourist packages

Any request for cancellation or modification of the Tourist Packages by the Client must be sent to BURGUNDY & MORE® by registered letter with acknowledgement of receipt; the date of
receipt will constitute the date of cancellation of the contract (or resolution).
Subject to special provisions which may be included in the summary sheet of the Tourist Packages ordered, the cancellation or modification of the Tourist Packages by the Client will result in the collection by BURGUNDY & MORE® of a sum corresponding to a percentage of the price of the Tourist Services, according to the following schedule:

The application fee is never refundable.
Deducted from amounts owing to BURGUNDY & MORE® in accordance with the above schedule,
the costs of the case and, if applicable, of excursions and the costs of BURGUNDY & MORE® undertakes to reimburse the Client within a reasonable period of time of all the sums previously paid by the latter.
The conditions for cancellation of the air services will be specified before the confirmation of the
reservation.

14.2. Accommodation services
Any request for cancellation or modification of the Hosting Services by the Client will give
location at the BURGUNDY & MORE® collection of the fees stipulated at the time of booking.
14.3. General provisions
In any case, if you wish, you may also be reimbursed for Services cancelled by you in the form of a credit note on your next order, valid for a period of one (1) year.
14.4. Assignment of Contract
In accordance with Article L 211-11 of the Tourism Code, the Client may assign its contract (excluding
insurance contract) to a third party, provided that it informs BURGUNDY & MORE® in writing at most
seven (7) days prior to the start of the stay, with the names and address of the transferee(s) and participant(s) on the trip and justifying that they complete the same conditions to travel (especially for children who must be in the same age group).
The transferor and the transferee are required to pay the balance of the price and the appropriate fees that will be indicated upon receipt of the assignment request.
Complementary insurance shall under no circumstances be refundable or transferable.
In the event of an assignment, the transferor assumes the obligation to inform the transferee of all the documents necessary to reach his destination, so that the latter cannot cancel on the grounds that he has not been informed or that he cannot leave.


Article 15: Proof / Archiving

The data entered by the Customer during the ordering process are kept within the BURGUNDY & MORE® IT system, and will be considered as evidence of communications, orders and payments between the Parties.
As a result, electronic data stored and archived by BURGUNDY & MORE® may be validly produced as evidence by BURGUNDY & MORE®and opposed to the Client in connection with any claim or legal action with the same probative force as any document that is established, received or kept in writing, which the Client expressly declares to accept.

The Customer may have access to all of its data, including its orders, on request sent by simple mail (Burgundy & More – GDPR Service – 25 rue du Général Leclerc – 89100 SENS- France) or by email (contact@burgundyandmore.com).
The provisions of this article shall apply to any electronic exchange between the Client, BURGUNDY & MORE® and/or its Partners.

Article 16: Release of Travel Documents

The necessary documents for your trip will be provided to you in good time before the start of the trip. The method of delivery of your travel documents related to the Services is specified in the summary form of your order.
Depending on the case, and in particular on the optional choices you selected when entering your order, your travel documents are given to you in one of the following modes:
• travel credentials: BURGUNDY & MORE® you the email address;
• Shipping by mail;
• Return to BURGUNDY & MORE® Head Office
• Sending by Chronopost * ;
* The shipping costs for this optional discount method are 25€ inclusive.

When you have expressed the wish that your travel documents be addressed to you by post, or when this method of delivery is imposed on you because of the impossibility of editing your electronic program,     BURGUNDY & MORE®  undertakes to send you your travel documents as soon as possible, and in any event no later than the day before your departure.

Article 17: Claims

Any complaint must be sent by registered letter with acknowledgement of receipt to BURGUNDY & MORE® within thirty (30) days from the end of the stay at Next: BURGUNDY & MORE®, 25 rue du Général Leclerc – 89100 SENS- France.
Failing a reply or a satisfactory reply within 60 days, the Traveller may free of charge and within one year of its complaint, the Ombudsman Tourism and Travel contact details:

The Client must report any non-conformance in the execution of the trip or stay on site to
the point of contact whose contact details have been communicated to it in the contract.

Rule 18: Responsibilities

18.1. In accordance with Article L. 211-16 of the Tourism Code, a professional who sells a package
tourist or travel service mentioned in 1° and 2° of article L. 211-1 is fully liable
right to perform the services provided for in this contract, without prejudice to its right of appeal against the service provider that performed the service or against any third party that contributed to the original event compensation, price reduction or other obligations.
The professional may, however, exempt himself from all or part of his responsibility by providing the proof that the damage is attributable either to the traveller or to a third party other than the supply of travel services included in the contract and is unpredictable or unavoidable, either to exceptional and inevitable circumstances.

The liability of BURGUNDY & MORE® may be determined and limited by international conventions governing the liability of a service provider providing a travel included in the trip or stay. In other cases, the travel contract may limit the damages at three times the total price of the stay, except in case of injury or injury caused intentionally or negligently.
18.2. In accordance with Article L 211-7 of the Tourism Code, the provisions of the Tourism Code do not apply to the sale of air fares or other tickets on a regular line alone. BURGUNDY & MORE cannot therefore be held responsible for the consequences of the following events:
– Loss or theft of airline tickets (airlines not issuing duplicates);
– Cancellation, delays, overbooking, loss or theft of baggage or other items.
BURGUNDY & MORE® may update these special terms of sale, in function of any legal, regulatory or technical development, with the understanding that amendments will be inapplicable to bookings prior to this amendment.

Article 19: No right of withdrawal

In accordance with the provisions of Article L. 221-28-12 of the Consumer Code, the right to retraction may not be exercised for contracts for the provision of services accommodation, other than residential accommodation, goods transport services, rentals Cars, catering or leisure activities that must be provided on a specified date or period.


Article 20: Insurance

The subscription of a resolution (cancellation) insurance of the contract is optional and will allow you obtain reimbursement of the costs of resolving your contract after a declaration to the insurer if the cause of the resolution is guaranteed, with the exception of the amount of the application fee and the amount of the insurance subscription.
Underwriting a repatriation/medical/death insurance is mandatory/optional according to cases and will be able to be dealt with in the event of incident, accident or death of passengers/their close. BURGUNDY & MORE® does not provide insurance, so it is up to each customer to assess whether or not they need insurance from an insurance professional for any travel with BURGUNDY & MORE®.

Section 21: Contract Documents

The Conditions of Use of the Site, the present Special Conditions of Sale, the conditions specific sales as listed in the summary sheet of the Services ordered, the if applicable, the general and special conditions of sale of the Partners, constitute the entire contractual documents applicable between the Parties.


Section 22: Applicable Law and Competent Courts

This contract is subject to the application of French law.
In the event of a dispute arising in connection with the interpretation, execution or termination of these Special Terms of Sale between BURGUNDY & MORE® and a User for a for professional use, the jurisdiction of the courts of the Court of First Instance shall be Sales of Sens 89100 .France.

Rule 23: Final Provisions

The fact that BURGUNDY & MORE® does not at any time avail itself of any provision of these Special Conditions of Sale may not be interpreted as a waiver by BURGUNDY & MORE® to avail itself of it later.
In the event that any of the provisions of these Special Conditions of Sale are declared null and void, it would be deemed unwritten, without affecting the validity of the other provisions, unless the provision declared null and void was essential and determinative.

II. STANDARD FORMS

The form corresponding to the Customer’s situation will be given to him before the conclusion of the contract.
BURGUNDY & MORE® publishes here the forms that may accompany its services: packages
in an agency or isolated service and which will be supplemented according to the situation.

Standard information form for package travel contracts in situations other than those covered by Part A: sale of agency packages
The combination of travel services offered to you is a package within the meaning of the directive
(EU) 2015/2302 and Article L.211-2 II of the Tourism Code.
You will therefore benefit from all the rights granted by the European Union applicable to packages,
as transposed into the tourism code.BURGUNDY & MORE® will be entirely responsible for the proper execution of the package as a whole.
In addition, as required by law, BURGUNDY & MORE® has protection to reimburse your payments and, if transportation is included in the package, ensure your repatriation in case
it(s) will become insolvent(s).

Essential rights provided for in Directive (EU) 2015/2302 transposed into the Tourism Code:
• Travellers will receive all essential information about the package before concluding the package travel contract.
• The organizer and the retailer are responsible for the proper performance of all travel services included in the contract.
• Travellers receive an emergency telephone number or contact information contact to reach the organizer or retailer.
• Travellers may transfer their package to another person, with advance notice reasonable and possibly subject to additional charges.
• The price of the package can only be increased if specific costs increase (per for example, fuel prices) and whether this possibility is explicitly foreseen in the contract, and in any case may not be modified less than 20 days before the start of the package.
If the price increase exceeds 8% of the price of the package, the traveller can resolve the contract. If
the organizer reserves the right to increase the price, the traveller is entitled to a reduction of price in the event of a decrease in the corresponding costs.
Travellers can resolve the contract without paying a resolution fee and be fully reimbursed for payments made if one of the essential elements of the package, other than the price, undergoes a significant change. If, before the start of the package, the professional responsible for the package cancels it, travellers can obtain the refund and compensation, if applicable.

Travellers may settle the contract without paying a resolution fee before the start of the package in exceptional circumstances, for example, if there are serious security problems at the destination that may affect the package.
• In addition, travelers may, at any time prior to the start of the package, resolve the contract upon payment of appropriate and justifiable resolution fees.
If, after the start of the package, important elements of the package cannot be provided as planned, other appropriate services will have to be offered to travellers, without additional cost. Travellers may resolve the contract without paying a resolution fee when the services are not performed in accordance with the contract, that this significantly disrupts the execution of the package and the organizer does not correct the problem.
• Travellers are also entitled to a price reduction and/or compensation in the event of non-performance or improper performance of travel services.
• The organizer or retailer must provide assistance if the traveller is in difficulty.
If the organizer or retailer becomes insolvent, the amounts paid will be refunded. If the organiser or retailer becomes insolvent after the start of the package and if transport is included in the package, traveller repatriation is guaranteed. BURGUNDY & MORE® has insolvency protection from APST. Travellers can contact this organization (APST, 15 avenue Carnot, 75017 PARIS-France – info@apst.travel ) if services are denied to them due to the insolvency of BURGUNDY & MORE®.

If you purchase this travel service, you will benefit from the tourism code fees.
BURGUNDY & MORE® will be fully responsible for the proper performance of the travel service.
In addition, as required by law, BURGUNDY & MORE® has protection to reimburse your payments in case it becomes insolvent. For more information about your rights

By clicking on the hyperlink, the traveller will receive the following information and essential rights
provided for by the tourism code:
• Travellers will receive all essential travel service information prior to concluding the travel contract.
• The service provider and the retailer are responsible for the proper performance of the travel service.
• Travellers receive an emergency telephone number or contact information to contact the service provider or retailer.
• Travellers may transfer their travel service to another person, with reasonable notice and possibly with an additional charge.
The price of the travel service may be increased only if specific costs increase and if this possibility is explicitly provided for in the contract, and in any case may not be changed less than 20 days before the start of the journey. If the price increase exceeds 8% of the price of the travel service, the traveller may resolve the contract. If the service provider reserves the right to increase the price, the traveller is entitled to a price reduction in the event of a decrease in the corresponding costs.

Travellers can resolve the contract without paying a resolution fee and be fully reimbursed for the payments made if one of the essential elements of the contract, other than the price, undergoes a significant change. If, before the start of the benefit, the professional responsible cancels the benefit, travellers may obtain reimbursement and compensation, if applicable.
• Travellers can resolve the contract without paying a resolution fee before the start of
the benefit in case of exceptional circumstances, for example if there are serious safety problems at the place of destination that are likely to affect the trip.
• In addition, travelers may, at any time prior to the start of the trip, resolve the contract upon payment of appropriate and justifiable resolution fees.
If, after the start of the journey, important elements of the journey cannot be provided as planned, other appropriate services must be offered to the travelers, without additional cost. Travellers may resolve the contract without paying a resolution fee when the services are not performed in accordance with the contract, that this significantly disrupts the execution of the journey and that the service provider does not remedy the problem.
• Travellers are also entitled to a price reduction and/or compensation in the event of non-performance or improper performance of the travel service.

• The service provider or retailer must provide assistance if the traveller is in difficulty.
If the service provider or retailer becomes insolvent, the amounts paid will be refunded.
